C.M.P.No.309 of 2015 in S.A.No.1867 of 2000 P.RAJAMANICKAM.J., This petition has been filed by the third party to implead himself as fourth respondent in the above second appeal.

2. Though several adjournments have been given for filing counter, counter not filed. No representation for the respondents 1 and 2 for the past several hearings. Today also, no representation for the respondents 1 and 2/appellants.

3. According to the petitioner, he has purchased the suit property during pendency of the second appeal on 05.09.2007 from the first respondent and hence he wants to implead himself as party to protect his interest.

4. Since the petitioner has purchased the property from the first respondent during pendency of the second appeal, he can contest the case by stepping into the shoes of the first respondent. Hence, this petition is allowed.
