Petition praying that in the circumstances stated therein the High Court will be pleased to
(1) modify the order dated 02.07.2018 in Crl.O.P.No.16238 of 2018. (CRL.MP.NO.10018/2018 IN CRL.OP.16238/2018)
(2) Extend the time to comply the condition in Crl.OP.NO.16238/2018. (CRL.MP.NO.10017/2018 IN CRL.OP.16238/2018) Order : These petitions coming on for orders upon perusing the petition and upon hearing the arguments of M/S.S.THIRUKKUMARAN, Advocate for the petitioner ( IN BOTH THE PETITIONS) and of Mr.M.Mohamed Riyaz, ADDL. PUBLIC PROSECUTOR ( IN BOTH THE PETITIONS) on behalf of the Respondent the court made the following order:- The Crl.MP.No.10018 of 2018 has been filed to modify the condition imposed on the petitioner in Crl.O.P.No.16238 of 2018 on 02.07.2018 and Crl.M.P.No.10017 of 2018 has been filed to extend the time.
2. The learned counsel for the petitioner would submit that though the application has been filed for anticipatory bail under Section 438 Cr.P.C., it has been wrongly typed as Petition for Bail under Section 439 Cr.P.C. He would also submit that the FIR is pending on the file of the Mahila Court, Chengalpet, whereas, he had wrongly typed bail to the satisfaction as XVII Metropolitan Magistrate, Saidapet. He would also submit that in the condition, it has been stated that the petitioner shall report before the Additional Sessions Judge, Mahila Court, Tambaram, whereas, the
petitioner is prepared to surrender before the Additional Sessions Judge, Mahila Court, Chengalpet.
3. Taking into consideration the submission made by the learned counsel for the petitioner, the petitioner is directed to surrender before the learned Additional Sessions Judge, Mahila Court, Chengalpet and execute the sureties and report before the said Court daily at 10.30.a.m until further orders.
4. Time granted by this Court to comply with the conditions, vide order dated 02.07.2018 passed in Crl.O.P. No.16238 of 2018, is extended by two weeks from the date of receipt of a copy of this order.
