Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, directing the respondents to pass orders on the representation dated 31.05.2018 seeking appropriate revised pension and pensionary benefits, including promotion on par with his junior on merits and within a time to be stipulated by this Court.

ORDER

By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner has come up with this writ petition seeking a direction to the respondents to pass orders, on his representation dated 31.05.2018 seeking revised pension and pensionary benefits, including promotion on par with his junior, on merits, within a stipulated time to be fixed by this Court.

The learned counsel for the petitioner submitted that though the disciplinary proceedings initiated against the petitioner were subsequently, dropped and the criminal case registered against him ultimately, ended in acquittal, his legitimate claim for settlement of retiral benefits, which had fallen due way back in the year 2000, has not been considered till date. Hence, the petitioner made a representation dated 02.05.2018 and reminder dated 31.05.2018 to the respondents and the same are pending, without any progress. Hence, this writ petition.

4. Mr.A.N.Thamidurai, learned Special Government Pleader taking notice for the respondents fairly submitted that the respondents would consider the petitioner's representation and pass appropriate orders on merits and in accordance with law, within a time frame to be fixed by this Court.

5. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court directs the respondents to consider the petitioner's representation dated 31.05.2018 and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of personal hearing to the petitioner as well as any of the interested parties, within a period of six (6) weeks from the date of receipt of a copy of this order.

6. Accordingly, this writ petition stands disposed of. No costs.

Consequently, connected Miscellaneous Petition is closed.
