Prayer: The Criminal Original Petition is filed under Section 482 of the Cr.P.C., to quash the proceedings now pending against the petitioner in C.C.No.335 of 2009 on the file of the learned Judicial Magistrate-VI, Coimbatore. When the matter came up for hearing on 03.09.2019, there was no representation on behalf of the petitioner and the matter was directed to be listed on 04.09.2019.

2. Today, when the matter is called, none appeared on behalf of the petitioner. Since the Original Petition is pending from the year 2013, and considering the fact, that the petitioner is not interested to conduct the case, this Court has no other option except than to dismiss the same for non prosecution.

3. Accordingly, the criminal original petition is dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
