JUDGMENT

When the Civil Miscellaneous Petition came up for hearing on 20.10.2021, there was no representation for the appellant and the learned counsel for the respondent has submitted that steps were not taken to bring on record the legal heirs of the deceased sole respondent. Hence, it is posted on 17.11.2021 for taking steps. Again, when the matter was listed on 01.12.2021, there was no representation for both sides. Hence, the Registry was directed to list the matter on 02.12.2021 under the caption, "for dismissal". Accordingly, it is listed today.

2. Even today i.e., on 02.12.2021, there is no representation for both sides. Hence, this Appeal is dismissed for non-prosecution. Consequently, the connected miscellaneous petition is closed.
