1. The Deputy Inspector General Of Police Villupuram Range, Villupuram Dist
2. The Superintendent Of Police Villupuram Dist ..Respondent(s) To review the common order dated 30.08.2019 passed in WA.No.331 of 2018 and restore the said appeals. REV.APPL No. 179 of 2021 To review the common order dated 30.08.2019 passed in
WA.No.332 of 2018 and restore the said appeals. In both applications For Petitioner(s):
Mr.D.Muthukumar, for M/s.Paul & Paul For Respondent(s):
Dr.R.Gouri, Government Counsel for R1 & R2 Order (Order of the Court was made by S.M.Subramaniam J.) Review Applications have been filed to review the common order dated 30.08.2019 passed in WA.No.331 of 2018 and WA.No.332 of 2018.
2. Learned counsel appearing on behalf of the review petitioners would mainly contend that writ appeals included in the batch of cases are unconnected and the facts are distinguishable. Therefore, judgment sought to be reviewed cannot be applied in respect of the appellants in the writ appeals. He would further submit that he brought to the notice of this Court during the final hearing. However, by mistake, it was tagged along with the writ appeals. Therefore, the writ appeals are to be heard independently by de-linking them from the batch of writ appeals.
3. Learned Government Counsel has no serious objection to allow to review applications and to rehear the writ appeals separately.
4. This Court is of the view that since error noticed is apparent on record, we are inclined to consider the review applications.
5. In view of the said position, the order made in WA.No.331 of 2018 and WA.No.332 of 2018 dated 30.08.2019 in respect of the writ appellants are recalled, and review applications are allowed. Registry is directed to list the writ appeals for final hearing before the Bench holding roaster. (S.M.S.,J.) (P.T.A.,J.) 05-06-2026 Index: Yes/No Speaking/Non-speaking order GD To
