( Criminal Jurisdiction ) Tuesday, the Eleventh day of January Two Thousand Twenty Two PRESENT The Hon`ble Mr Justice A.D.JAGADISH CHANDIRA CRIMINAL MISCELLANEOUS PETITION No.126 of 2022 IN CRL.R.C.935 of 2021 K.JAYARAMAN [ PETITIONER/APPELLANT ] Vs V.PANDIYAN [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the time in complying the condition imposed by this Hon`ble Court in the order dated 13.12.2021 made in Crl.M.P.No. 12786 and 12787 of 2021 in Crl.R.C.935 of 2021 by appreciating the above facts and circumstances and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.GURUPRASAD, Advocate for the petitioner and of MR.SWAMI SUBRAMANIAN, Advocate on behalf of the Respondent the court made the following order:- Learned counsel appearing for the petitioner would submit that this Court by order dated 13.12.2021, while suspending the sentence had directed the petitioner to deposit 50% of the cheque amount within a period of two weeks from the date of receipt of a copy of that order.

2. He would further submit that the order copy was made ready on 15.12.2021, however, since the Court was closed for Christmas vacation, the petitioner was unable to file the petition seeking for extension of time and the petition has been filed immediately on the date of reopening the Court. He would further submit that the petitioner is an aged person and facing illness and thereby, he would seek extension of time to deposit the amount. https://hcservices.ecourts.gov.in/hcservices/

3. Considering the facts and circumstances of the case, time granted by this Court in Crl.M.P.Nos.12786 & 12787 of 2021 by order dated 13.12.2021, is extended by further period of two weeks from today.

4. Learned counsel for the petitioner is directed to serve papers on Mr.Swami Subramanian, learned counsel for the respondent.
