PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to sub-divide Survey No.158 to an extent of 0.20 Punja Acers in Palacode Village, Palacode Taluk, Dharmapuri District to issue a separate patta in the name of the petitioner based on the petitioner application dated 15.11.2024.

ORDER

Seeking a direction to the second respondent to consider her online application dated 15.11.2024 for subdivision and for issuing a separate patta in her name in respect of the property measuring 0.20 punja acres in Survey No.158, Palacode Village, Palacode Taluk, Dharmapuri District, the petitioner is before this Court.

2. Heard the learned counsel for the petitioner and the learned Government Advocate accepting notice for the respondents.

3. The case of the petitioner is that she is the absolute owner of the subject property. She acquired it by way of purchase vide sale deed dated 06.6.2008 registered as doc.No.1447 of 2008 on the file of the Sub-Registrar, Palacode for a valid sale consideration. Ever since the date of purchase, she has been in possession and enjoyment of the same. The petitioner made an online application dated 15.11.2024 to the second respondent seeking to subdivide the subject property and to issue a separate patta in her name by paying necessary charges. As no action has been taken on the same, the petitioner has come forward with this writ petition.

Considering the limited nature of the relief sought, the writ petition is allowed and a Mandamus is issued to the second respondent to consider the online application of the petitioner dated 15.11.2024 for subdividing the subject property and for the issuance of a seperate patta in her favour on merits and pass appropriate orders in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
