Respondents Prayer: Writ Petition is filed under Article 226 of Constitution of India to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 21.10.2024 and thereby direct the 4th 1/4

respondents to issue patta in respect of the property situated at Anumathapuram Village, Irudhukottai Post, Denkanikottai Taluk, Krishnagiri District, comprised in S.No. 88 to an extent of 5 Acres in the name of the petitioner within a stipulated period of time. For Petitioner :

ORDER

Aggrieved by the fact that, despite submitting a representation on 21.10.2024 for issuance of a patta, the patta has not yet been issued, the petitioner is before this Court.

It is the case of the petitioner that the property, comprised in S.No.88 to an extent of 5 acres, situated at Anumanthapuram Village, Irudhukottai Poost, Denkanikottai Taluk, Krishnagiri District, is classified as Podukal lands and the petitioner had constructed a house and obtained electricity connection and residing in the aforesaid property for the past 15 years. The petitioner was in continuous possession and enjoyment of the aforesaid property. Therefore, the petitioner given a representation dated 21.10.2024 to the respondents for issuance of patta. However, the same has not been considered to date. Therefore, the present writ petition. 2/4

3. Heard the learned counsel appearing on either side and perused the materials available on record.

4. Considering the fact that the representation has been made as early as on 21.10.2024, for which the forth respondent has not even commenced an enquiry. It is clear that he has failed in his statutory duties. Therefore, a mandamus is issued to the fourth respondent to consider the representation of the petitioner dated 21.10.2024 and issue patta within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition stands allowed. No costs.
