R.SWARNA Petition praying that in the circumstances stated therein the High Court will be pleased To stay of all further proceedings in the order dated 15.06.2017 made in M.P.No.179 of 2017 in M.C.No.371 of 2016 pending on the file of Principal Judge Family Court, Chennai pending disposal of the above M.P. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.ARUN,Advocate for the petitioner the court made the following order:- Since the revision has been filed against the order granting interim maintenance as the main maintenance case is still pending before trial Court and according to the learned counsel for the petitioner, the petitioner herein is ready to live with the first respondent and he never wants to part away from the respondent and therefore the very order of directing the petitioner to pay a sum of Rs. 7,000/- as interim maintenance is not only unwanted but also on the higher side.
2. Considering the above said aspects, as some arguable issues are available in this case and the same can been decided only after hearing the respondent, in order to make an interim arrangement, this Court is inclined to grant an order of interim stay of the impugned order on condition that the petitioner shall pay a sum of Rs.4,000/- per month as interim maintenance to the respondents and the said amount shall be paid on or before 10th of every succeeding English calender month and he shall continue to pay the same until further orders and the petitioner shall also pay a sum of Rs.16,000/- being the arrears of maintenance at the rate of Rs.4,000/- per month, from the month of April 2017, within a period of four weeks from today.
