ORDER

This writ petition has been filed to call for the records on the file of the respondent in Proceedings No. Ma.Aa.11 Na.Ka.No. A3 / 13846 / 2019 dated 31.12.2019 and to quash the same as illegal, incompetent, without jurisdiction and to direct the respondent to put the petitioner in possession of the portion of the property situated at Door 33, Gandhiji street, Alwarthirunagar, Valasaravakkam, Chennai to the petitioner and for a consequential orders.

It is stated that the petitioner Association claims that a portion of the subject had been leased out to the respondent /Corporation for a period of 99 years and that a community hall had been constructed thereon. Therefore, the espondent /Corporation was permitted to occupy a portion of the premises temporarily when their office building was demolished. After quite some, the petitioner submitted a representation dated 27.07.2009 seeking allotment / return of the said property to them. Ventilating their grievance, the petitioner Association submitted a representation before the 1st respondent. According to the petitioner, instead of properly considering the said representation, the respondent, by the impugned order dated 31.12.2019, rejected the request and proceeded to demolish the superstructure put up by the petitioner Association. 2/5

Challenging the same, the present writ petition has been filed.

3. Heard the learned counsel on both sides and perused the materials placed on record.

Upon this Court pointing out that the petitioner has a remedy before the Appellate Authority viz., Commissioner, Greater Chennai Corporation, Chennai, learned counsel for the petitioner, in obedience thereto, seeks permission to file an appeal as against the impugned order before the Appellate Authority. Further, she prayed for issuance of a direction from this Court to the respondents to consider and dispose of the said appeal, within a short time frame.

5. In view of the above, the Commissioner, Greater Chennai Corporation, Chennai, is suo motu impleaded as the 2nd respondent.

6. Learned Standing Counsel appearing for the respondent has stated no objection for issuance of appropriate directions in this regard.

7. Accordingly, liberty is granted to the petitioner to file an appeal before the 2nd respondent, within a period of two weeks from the date of receipt of a copy of this order. If such an appeal is filed within the aforesaid period, the 2nd respondent shall consider the same and pass orders on its own merits and in accordance with law, after affording opportunity to all concerned parties, within a period of four weeks thereafter.

8. With the above directions, this writ petition stands disposed of. No costs.
