3. Heard the learned counsel appearing on behalf of the petitioner, as well as the learned counsel appearing for the respondents.

4. Learned counsel appearing for the respondents has no objection for the miscellaneous petition being allowed.

5. In view of the submissions made by both the learned counsels and in view of the averments made in the affidavit filed in support of the miscellaneous petition, this petition is allowed and the delay of 3 days in filing the Civil Miscellaneous Appeal is condoned. Registry is directed to number the Civil Miscellaneous Appeal and list

the same for admission.
