PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of writ of Certiorarified Mandamus, directing to call for the records relating to the order made in Rc.No.8449/A&1/2008 dated 31.12.2010 by the 2nd respondent and quash the same and consequently direct the respondents 2 and 3 to consider the petitioner for the post of Assistant Executive Engineer and appoint him in the said post.

It is represented by the representing counsel that Mr.Mohan, learned counsel for the petitioner is no more. However, this Court perused the material on record including the impugned order dated 31.12.2010. By virtue of the impugned order, the deputation period for one Mr.R.Ravichandran, Assistant Engineer (Civil) of Salem Cooperative Sugar Mills to Tamil Nadu Co-operative Sugar Federation Limited was extended for further period of one year with effect from 01.11.2010 to 31.10.2011 for the purpose of looking after the civil works involved in the ongoing new projects in Co-operative and Public Sector Sugar Mills. As the said extended period of deputation has 2/5

already come to an end on 31.10.2011 practically, the relief sought in the writ petition has become infructuous. Further, it is contended by the learned Government Advocate that the said impugned order is construed as an order of promotion to the post of Assistant Executive Engineer and the present writ petition came to be filed, though, the impugned order is only an extension of the deputation of the diversion for a limited period. 2.In the light of the above, the relief sought in the writ petition has become infructuous. Even otherwise, the writ petition is filed totally on misconception of facts and the impugned order. 3.Accordingly, the writ petition stands dismissed as infructuous. No costs.
