J U D G M E N T

The learned counsel appearing on behalf of the appellant made a submission that the issues between the parties to the appeal suit has already been settled out of Court. Accordingly, a petition is filed to withdraw the appeal suit.

2. In view of the fact that the issues between the parties to the lis on hand are settled, no further adjudication needs to be entertained in respect of the grounds raised in the appeal suit.

3. Accordingly, the appellant is permitted to withdraw the appeal suit and the same stands dismissed as withdrawn. The appellant is entitled for the reimbursement of the Court fee as per the Rules in force. No costs. Connected miscellaneous petition is closed.
