PRAYER:Criminal Original Petition is filed under Section 482 of Cr.P.C., to withdraw the case in Crime No.7 of 2011 from the file of the 3rd respondent and transfer the same to the file of the 4th respondent with a direction to conduct further investigation within the period that may be stipulated by this Court.

ORDER

The Criminal Original Petition has been filed by the petitioner to withdraw the case in Crime No.7 of 2011 from the file of the 3rd respondent and transfer the same to the file of the 4th respondent with a direction to conduct further investigation within the period that may be stipulated by this Court.

2.The petitioner seeks direction of this Court to withdraw the Crime No.7 of 2011 pending on the file of the 3rd respondent namely the Inspector of Police, B-4 Police Station, Coimbatore District and transfer the investigation to the 4th respondent i.e. The Inspector of Police, CBCID, Coimbatore District. The crime is of the year 2011, now, almost eight years have been lapsed and hence, due to the lapse of period, the prayer sought for by the petitioner cannot be considered now. 3.Considering the long pendency of the case, the 3rd respondent is hereby directed to complete the investigation in Crime No.7 of 2011 and file a final report within a period of four weeks from the date of receipt of copy of this Order, before the jurisdictional Magistrate, if not already filed. 4.With the above direction, this Criminal Original Petition stands disposed of.
