Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records in Award No.5 of 2009 dated 16.11.2009 on the file of the 3rd respondent and quash the same in respect of petitioner's land measuring about 857 sq.ft., out of 1782 sq.ft., situate in Old Survey No.176/1 and new Survey No.R.S.No.176/1A/2 situate in Kurumbapet Village, Villianur Taluk, Pondicherry and consequently direct the 3rd respondent to conduct award enquiry and to re-fix the compensation under provisions of Right to fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013). The learned counsel for the petitioner seeks leave of the Court to withdraw this writ petition as certain inadvertence may have occurred, he seeks leave of the Court to file a fresh petition on the same cause of action with full and correct particulars.
