SELVAM [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Crl.R.C.No.579 of 2017 on the file of the High Court, the High Court will be pleased to order Extention of time for Two weeks to deposit the above said sum of Rs.1,50,000/-to the credit of S.T.C.No.83 of 2014 on the file of the Fast Track Court (Magisterial Level), Ambattur, and thus.
Order : This petition coming on for orders upon perusing the petition and Memorandum of Grounds in Crl.R.C.No.579 of 2017 On the file of the High Court and upon hearing the arguments of M/S.J.V.SATHYANARAYANAN, Advocate for the petitioner and of M/S R.PANDIYAN, Advocate for the Respondent, the court made the following order:- This petition has been filed to extend the time granted by this Court to comply with the conditional order passed on 13.04.2017.
2. This Court, by order dated 13.04.2017, while suspending the sentence, has imposed the condition that the petitioner shall deposit a sum of Rs.1,50,000/- to the credit of S.T.C.No.83 of 2014 on the file of the Fast Track Court (Magistrate Level), Ambattur, within a period of eight weeks, which was over as early as on 13.06.2017.
3. The present petition has been filed on 13.07.2017 with a prayer to grant further time of two weeks. Even after the expiry of eight weeks time, as per the order of this Court, further time of almost eight weeks have gone and even still Mr.J.V.Sathyanarayanan, learned counsel for the petitioner requested for further time of at least two weeks, so that the petitioner can mobilize the fund to deposit the said sum towards complying with the conditional order.
4. If the petitioner is unable to mobilize the fund within a period of eight weeks, as per the order of this Court, he should have at least approached this Court well in time. However, even after the expiry of the period, he filed the present petition belatedly after one month and even after one month, today, on behalf of the petitioner, further time of two weeks was sought for.
5. Considering the attitude of the petitioner in not only complying with the order of this Court but also not approaching this Court even after the expiry of time, this Court is of the considered view that this petition may be allowed only one terms.
6. Accordingly, a further time of two weeks is given from today (11.08.2017) to the petitioner to comply with the order dated 13.04.2017, with costs, and the petitioner shall pay a sum of Rs.5,000/- to the High Court Legal Services Authority within the period of two weeks. It is made clear if the final chance given by this Court is not utilized by the petitioner properly, no indulgence can be shown to him and accordingly, he has to face the consequences. This petition is ordered accordingly.
