CMP Nos.342, 343 and 344 of 2013 have been filed by the petitioners i)to condone the delay of 2405 days in filing the petition to set aside the abatement caused due to the death of the first respondent; ii) to set aside the abatement caused due to the death of the first respondent and iii) to bring on record the legal representatives of the deceased first respondent as respondents 8 to 12 b) CMP Nos. 10353, 10361 and 10373 of 2021 have been filed by the petitioners i)to condone the delay of 4303 days in filing the petition to set aside the abatement caused due to the death of the fourth respondent; ii) to set aside the abatement caused due to the death of the fourth respondent and iii) to bring on record the legal representatives of the deceased fourth respondent as respondents 15 and 16 and c) CMP Nos.10365, 10369 and 10372 of 2021 have been filed by the petitioners i)to condone the delay of 2105 days in filing the petition to set aside the abatement caused due to the 1/3
death of the second respondent; ii) to set aside the abatement caused due to the death of the second respondent and iii) to bring on record the legal representative of the deceased second respondent as respondents 13 and 14 in the above Second Appeal.
2. Heard Mr.T.M.Hariharan, learned counsel for the petitioners.
3. This Court is of the considered view that without prejudice to the rights and contentions of the respective parties with regard to bringing on record the Legal Representatives of the deceased, all these CMPS can be allowed. Accordingly, these CMPS are allowed as prayed for.
4. Registry is directed to carry out necessary amendments and list the main Second Appeal for hearing on 10.08.2021. 13.07.2021 (1/3) vsi2 2/3
