Appeals under Section 96 of the Code of Civil Procedure, 1908, against the judgment and decree made in O.S.No.30 of 2007, on the file of the District Judge, Thiruvannamalai, dated 23.02.2011.

JUDGMENT

The learned counsel appearing on behalf of the appellants as well as the learned counsel appearing on behalf of the respondents made a submission that the issues between the parties had already been settled out of Court. The Appeal Suit has not been taken up for disposal. Even before taking up the appeal suit for hearing, the parties had settled the issues out of Court.

2. The appellant is entitled for refund of full court fee under Section 69(A) of the Tamil Nadu Court-Fees and Suits Valuation Act 1955. The Registry is directed to refund the Court fee by following the procedures.
