ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 294(b), 448 and 506(ii) I.P.C r/w 3(1) TNPPDL Act, on the file of the respondent police, in Crime No.42 of 2017, seek anticipatory bail.
2. The learned Government Advocate (Crl.side) opposed this petition contending that investigation is not yet over and there is damage to the properties to the tune of Rs.20,000/-. 3.The learned counsel for the petitioners submitted that the petitioners are willing to deposit a sum of Rs.5,000/- (Rupees Five Thousand only) each, towards alleged damages to the property. 4.Considering the nature of the offences and the age of the peititioners 1, 2, 4 and 5 being 70 plus, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.
5. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Jayamkondam, on condition that the petitioners shall deposit a sum of Rs.5,000/- (Rupees Five Thousand only) to the credit of Crime No.42 of 2017 on the file of the learned Judicial Magistrate, Jayamkondam within a period of two weeks from today, failing which, the order shall stand automatically cancelled and on further condition that the petitioners shall execute bond for a sum of Rs.10,000/- [Rupees Ten Thousand only] each, with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition to appear before the respondent police every Monday at 10.00 a.m for a period of two months and thereafter, as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of three weeks from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
