The petitioner/accused in Crime No.28 of 2023, registered by the respondent police under Section 363, 366 of IPC and Section 3 r/w 4 of POCSO Act and Sections 9 and 11 of Prohibition of Child Marriage Act, 2006 seeks anticipatory bail.
2. It is the case of the prosecution that the victim child had developed relationship with the first accused and the present petitioner was also present when the first accused had married the victim child. Later, the first accused also had physical relationship with the victim child. The statement of the victim child had been examined by this Court, where the name of the petitioner is also reflected.
3. Taking into consideration that investigation has to be done and all other surrounding factors, I am not inclined to grant anticipatory bail to the petitioner.
