Respondents Petition under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, forbearing the respondents, their officials, agents, men or any one on their behalf from in any way interfering with the petitioner's use of the road situate on Survey Field No.2, Kannankottai Village, Gummidipoondi Taluk, Tiruvellore District for the purpose of plying lorries to remove gravel from the Survey Field No.1 of the village and transport to the place of petitioner. ORDER

When the matter was called on 15.10.2019, neither the petitioner nor his counsel was present. So the Registry was directed to list the matter under the caption "for dismissal". https://hcservices.ecourts.gov.in/hcservices/

2. When the matter is taken up today, there is no representation for the petitioner. However, the learned Additional Government Pleader for the respondents stated that the prayer has become infructuous.

3. Since the petitioner has pleaded that the order granting permission was only for a brief period of about 1 1⁄2 months and by virtue of the order of injunction granted by this Court, the 1 1⁄2 months period was also utilised by the petitioner, the prayer has become infructuous. Therefore, the writ petition is dismissed as infructuous. Consequently, M.P.Nos.1 & 2 of 2013 are also dismissed. No costs.
