BALASUBRAMANIAM Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay all further proceedings pursuant to the Judgment and Decree dated 07.06.2018 passed in O.S.No.161 of 2014 on the file of II nd Additional district and Sessions Judge, Tiruppur (IN CMP No.2987 of 2019)pending disposal of the above IN AS.NO.64 OF 2019.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of BHARATH KUMAR R., Advocate for the petitioner and of M/S.C.R.PRASANNAN KUNDAVAI, ADVOCATE (CAVEATOR) on behalf of the Respondents the court made the following order:- (Order of the Court was made by M.M.SUNDRESH,J.) The appellant is the defendant in the suit for partition and separate possession. The suit having been decreed, the present appeal has been filed. Pending the appeal, the present petition has been filed for stay of further proceedings.

2.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the caveator. 3.Considering the submissions made, there shall be an order of interim stay of passing of final decree alone. It is made clear that the other proceedings may go on and there is no order as to costs.

4.Considering the issues involved, Registry is directed to call for the records and make the papers ready.
