This Court, on 15.06.2023 in Crl.M.P.No.7532 of 2023, had granted interim suspension of sentence and bail to the petitioners A2 and A3 for a period of three months. In that order, the petitioner/A2 was inadvertently omitted to be mentioned. Hence, the case was again listed under the caption "for being mentioned". On 20.06.2023, the issue was clarified and an order was passed directing the petitioner/A2 to pay 20% of the fine amount imposed on him within a period of two months from the date of his release. 2.The submission of the learned counsel for petitioner/A2 is that within the stipulated period, the 20% of the fine amount, which works out to Rs.17,62,200/- could not be remitted before the Lower Court. Hence, the petitioners A2 and A3 filed Crl.M.P.No.13573 of 2023 before this Court seeking extension of time. This Court, by order dated 11.10.2023, granted 1/4

extension of time directing A2 and A3 to remit the said amount on or before 14.11.2023. Thereafter too, the petitioner/A2 was unable to mobilise the funds. When petitioner mobilised the funds and approached the Lower Court, the Lower Court not permitted the petitioner to remit the fine amount for the reason that it is beyond 14.11.2023. Hence, the present petition has been filed.

3.Today, the learned counsel for the petitioner/A2 had produced the copy of Demand Draft of 20% of the fine amount, i.e., Rs.17,62,200/- favouring to the credit of C.C.No.37 of 2013 on the file of learned Special Judge, Special Court under TNPID Act. A scanned reproduction of the same is as follows:

4.In view of the same, the petitioner is granted two weeks time from today to remit the fine amount before the Lower Court. The learned Special Judge, Special Court under TNPID Act, Coimbatore is directed to accept the Demand Draft bearing No.073972 dated 18.01.2024 for Rs.17,62,200/- and credit to the account of C.C.No.37 of 2013. This exercise to be completed within a period of two weeks from the date of receipt of a copy of this order. 5.Accordingly, this Criminal Miscellaneous Petition is ordered. 19.01.2024 rsi 3/4
