Mr.K.M.D.Muhilan, Additional Public Prosecutor Mr.G.Martinmanivannan - R4 Order This Writ Petition has been filed seeking a direction to forbear the respondents 1 to 3 from interfering in the civil dispute in respect of the compliant in Current Paper Enquiry in C.No.141/SPGDP/DSP/DCB-II/CPT/25 on the file of the second respondent and consequently direct the respondents 1 to 3 to not to harass the petitioners under the guise of enquiry or summoning the petitioners.

The learned counsel appearing for the petitioners would submit that the fourth respondent has given a complaint against the petitioners in respect of a civil dispute and based on the said complaint, the official respondents are conducting enquiry. He further submitted that when the dispute is civil in nature, the police have no jurisdiction to conduct any inquiry on the above complaint. Hence, the present Writ Petition.

3. The learned Additional Public Prosecutor, on instructions, submitted that the first respondent has forwarded the complaint given by the fourth respondent to the second respondent and the same is pending before the second

respondent in C.No.141/SPGDP/DSP/DCB-II/CPT/25. He would further submit that the petitioner had also approached the learned Magistrate under section 156(3) of Cr.P.C. seeking a direction to register a case. It is his further submission that the second respondent is conducting preliminary enquiry as mandated under section 175 BNSS and the respondents will not interfere in the civil dispute and the second respondent will complete the enquiry within a period of four weeks.

4. Recording the above submissions, the second respondent is directed to complete the enquiry in C.No.141/SPGDP/DSP/DCB-II/CPT/25 within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition Criminal is disposed of. Consequently, connected miscellaneous petition is closed. 12-01-2026 Index: Yes/No Speaking/Non-speaking order vrc
