WMP.No.486 of 2023 in W.P.No.17482 of 2023 N.ANAND VENKATESH , J Heard the learned counsel for the petitioner, the learned Senior Counsel appearing on behalf of the Wakf Board and also the learned counsel appearing on behalf of the writ petitioner Mr.Venkatesh, who appears for an erstwhile Muthawalli submitted that he has filed an impleading petition and that the same has not been numbered by the Registry. On hearing Mr.Venkatesh, it is seen that there is commonality in the grievance that has been expressed by the writ petitioner and the erstwhile Muthawalli and both of them are complaining that there is mismanagement and misappropriation. Therefore, it is not necessary to entertain one more impleading application and it will suffice to hear Mr.Venkatesh. The writ petitioner has also filed a counter affidavit in this petition. 2.
The learned counsel for the petitioner brought to the notice of this Court the proceedings pending before the Apex Court in S.L.P.No.22681 of 2023 and also the proceedings pending before the Wakf Tribunal in W.O.S.No.70 of 2020. 3.The Wakf Board is directed to file an affidavit in this case and take a specific stand with respect to the further course of action that is intended to be taken by the Wakf Board. Based on the stand taken by the Wakf Board, further orders can be passed in this petition.
