2. The learned counsel for the petitioner would submit that in the earlier order dated 18.08.2023 while disposing of Arb.O.P.(Com.Div.)No.21 of 2023, this Court had issued various directions. But, however, it has omitted to disclose the time frame within which the new arbitrator will have to pronounce the arbitral award.

3. Even though the learned counsel for the respondent would submit that a formal application will have to be filed under Section 29-A of the Arbitration and Conciliation Act seeking for extension of time, this Court does not find it necessary, since the earlier application was filed both under Sections 29A of the Arbitration and Conciliation Act as well as under Sections 14 and 15 of the Arbitration and Conciliation Act. No prejudice will be caused to the respondent if a time frame is fixed by this Court in view of the fact that the earlier arbitrator had withdrawn himself from the 1/3

arbitration due to his ill-health and six months' time was lost in the arbitration.

4. For the foregoing reasons, the learned arbitrator appointed by this Court in its order dated 18.08.2023 passed in Arb.O.P.(Com.Div.) No.21 of 2023 is directed to complete the arbitration within a period of six months from the date of receipt of papers from the erstwhile arbitrator. This order is issued in conjunction with the earlier order dated 18.08.2023 passed in Arb.O.P.(Com.Div.) No.21 of 2023.
