The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 7, 9 of the Cigarette and other Tobacco Product Act 2003, r/w 328 of IPC, in Crime.No.1229 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found illegal possession of 5 Tonnes of banned tobacco products. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and is no way connected with the alleged offence. He would further submit that on the confession statement given by the co-accused, the petitioner has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that the petitioner was found illegal possession of 5 Tonnes of banned tobacco products. He would further submit that two similar previous cases are pending against the petitioner and hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also that the seized tobacco products were of huge quantity, this Court is not inclined to grant bail to the petitioner.
