On 09.12.2019 also, there was no representation on behalf of the appellant and again, it was posted under the caption 'For Dismissal' on 11.12.2019. On 11.12.2019, there was a representation on the ground that the appellant is ready to proceed with the appeal and accepting the request made on behalf of the appellant, the case was adjourned. Again the matter was listed on 09.01.2020, there was no representation on behalf of the appellant and again, it was directed to be listed under the caption 'For Dismissal' on 21.01.2020.

2. When the matter is listed today, i.e., on 21.01.2020, none appeared for the appellant and this Court has to draw an inference that the appellant is not interested in pursuing the matter. Accordingly, the appeal suit in A.S.No.199 of 2017 stands dismissed for non-prosecution. However, there shall be no order as to costs.
