ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the respondent bank to disburse the fixed deposit that stands in the name of the petitioner's deceased husband Ganesan along with accrued interest within the time stipulated by this Court.

2.When the writ petition was taken up for hearing today, the learned Standing Counsel appearing on behalf of the respondent bank submitted that insofar as the fixed deposits which are found at Sl.Nos.2, 3 and 4 of the relief sought for in the writ petition, they were closed on 11.03.2014 even during the lifetime of the petitioner's husband who died only on 03.12.2015. Insofar as the fixed deposit found at Sl.No.1 of the relief sought for in the writ petition, the nomination was made in favour of one Lakshminarayanan and based on the nomination, the amount was disbursed and the fixed deposit was closed and paid to the said Lakshminarayanan on 15.03.2018. In view of the same, all the four fixed deposits have been disbursed by the Bank.

Out of the four, three were disbursed during the lifetime of the husband and one was disbursed after the lifetime of the husband to one Lakshminarayanan. 3.In the light of the above development, the relief as sought for in the present writ petition cannot be granted by this Court and recording the stand taken by the bank, this writ petition is disposed of.
