This Appeal is filed under Section 96 of the Code of Civil Procedure, against the Decree and Judgement dated 27.06.2002 in O.S.No.6 of 2002 on the file of Additional District Court, Fast Track Court, II, Cuddalore decreeing the suit for specific performance.

Mr. M. Baskar JUDGEMENT This Appeal arises from the suit for specific performance. The appellant is the defendant in the suit in O.S.No.6/2002 on the file of the Fast Track Court, II, Cuddalore.

2. Today (29.11.2018), the parties have filed a Memorandum of Compromise, in which it is stated that the party of the second part has repaid a sum of Rs.17,00,000/-(Rupees Seventeen Lakhs only) and the plaintiff/respondent has accepted the said payment and has stated that he has no further claims against the appellant /defendant, in respect of the suit schedule property.

3. The respondent/plaintiff has also executed necessary letter for having the order of attachment made through Court raised. The Memorandum of Compromise is taken on file and recorded.

4. The Second Appeal is disposed of on the lines of the Memorandum of Compromise. The Memorandum of Compromise shall form part of the Decree. No costs.
