ORDER

This petition has been filed to condone the delay of 321 days in filing this appeal.

2. Both side counsels appeared before this Court.

3. The learned counsel for the petitioner submits that due to lack of communication between the petitioner and his counsel the petitioner was not able to get the copy of the bundle and not able to file the appeal on time.

4. The learned counsel for the respondent raised strong objection to allow this petition.

5. Considering the fact, this Court is inclined to give one more opportunity to the petitioner and also to avoid multiplicity of proceedings this Court is inclined to allow this petition with the condition that the petitioner shall pay a cost of Rs.3,000/- to the respondent counsel. Accordingly, this petition is allowed. Registry is directed to number the Second Appeal if it is otherwise
