C.M.P.No.4970 of 2021 in M.SUNDAR.J., Mr.N.Karthikeyan, learned counsel for petitioners and Mr.P.Jagadeesan, learned counsel for lone respondent are before this Virtual Court.

2. When the captioned second appeal was filed, A.Shanmugam, son of Arumuga Gounder was the lone appellant and he died pending second appeal, his demise being on 17.01.2020. This has necessitated the filing of captioned Civil Miscellaneous Petition, which is with a prayer to bring on record the six legal heirs of Late A.Shanmugam as appellants.

3. Learned counsel for lone respondent submits that he has no objection or opposition to the prayer in the captioned CMP.

4. This Court, having heard learned counsel for petitioners, having perused the supporting affidavit and having noticed that prayer in the captioned CMP is not only innocuous, but imperative for carrying the second appeal to its logical end, is of the view that prayer has to be acceded to.

5. Therefore, captioned CMP ordered as prayed for.

6. Registry to carry out necessary and consequential amendments in the case file within a fortnight from today i.e., on or before 09.07.2021. Captioned CMP ordered as prayed for with above direction. No costs.
