This Civil Miscellaneous Petition has been filed seeking to set aside the order of dismissal stating the reason that the sole appellant died on 17.09.2020 and during the Covid-19 pandemic period, as she was not able to take steps, the Second Appeal was dismissed as abated with a liberty to the petitioners herein to file necessary application. Now, she has filed this petition to set aside the order of dismissal dated 11.11.2021 in the above Second Appeal and restore the same on file.

2. The learned counsel for respondents 1 to 5 has submitted that she has no objections in allowing this petition.

3. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, this Court is inclined to allow this petition and the second appeal is restored.

4. Post the second appeal on 21.07.2022.
