ORDER : The Court Made the following order :- Heard both sides.
2. The petitioners are alleged to have committed offence under Sections 341, 506 (ii), 307 and 302 IPC.
3. Learned counsel for the petitioners submits that the petitioners have been in custody from 05.04.2017, that the petitioners are innocent of the offences, that there is absolutely no overtact as against the petitioners 3 to 4 to implicate them for the offence under Section 302 IPC and therefore, they may be enlarged on bail.
4. Learned Government Advocate (Crl. side) opposes this application contending that the investigation is at preliminary stage.
5. The first petitioner is the son of the deceased. The second petitioner is father-in-law of the first petitioner. The third and fourth petitioners are family members. In this case, mother and father were attacked by their own son, first petitioner along with his father-in-law, the second petitioner, who are arrayed as A1 and A2.
6. As per the FIR, the overt act attributed as against the third and fourth petitioners is that they threatened the defacto-complainant when attempted to interfere with dire consequences. The occurrence took place on 05.04.2017 early morning. The petitioners were arrested on the same day. The investigation is at preliminary stage. Therefore, this Court is not inclined to enlarge the petitioners on bail. Hence, this petition is dismissed.
