This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 along with relevant Rules of the Original Side of Madras High Court seeking Succession Certificate relating to the securities in the name of Mr.Syed Jabbar who died intestate on 20.12.2017. He was the father of the 1st, 3rd, 4th and 5th petitioners and husband of the 2nd petitioner. At the time of his death, he had left behind shares in his name in Apollo Hospitals Enterprise. The details had been listed out in the schedule A of the petition. There is a representation on behalf of the respondent and the learned counsel stated that the respondent has no objection for grant of succession certificate with respect to share as given in schedule B. 2.After following due procedure, the petitioners were directed to tender evidence.

Accordingly, the 1st petitioner, Mr.Syed Abdul Nadeem examined himself as PW-1. The details relating to the share certificate was marked Ex.P1. The death certificate and legal heirship of Mr.Syed Jabbar were marked as Exs.P2 and P3. The learned counsel for the respondent had made an endorsement that the respondent had no cross-examination. https://www.mhc.tn.gov.

smv 3.Taking into consideration the nature of evidence adduced and the documents produced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the first petitioner in accordance with the rules.
