This Criminal Revision Case has been filed by the petitioner / husband to set aside the exparte order dated 12.12.2018 passed by the VI Additional Family Judge, Chennai in M.C.No.263 of 2018, whereby, the petitioner / husband was directed to pay the monthly maintenance of Rs.20,000/- to the respondent / wife from the date of petition i.e. 27.06.2018.
2.Today, when the matter was taken up for consideration, the learned counsel appearing for the respondent drew the attention of this Court to the memo dated 07.03.2019 filed by the petitioner, wherein, it is stated as follows: It is submitted that the petitioner has not turned up for further instructions and whenever he called for he used to evade the same and not responded positively. Further to that on repeated reminders, the petitioner called upon the counsel and informed the counsel that he will take change of vakalath and case bundle. Accordingly when the case came up for further hearing those facts were informed to the court, to that https://hcservices.ecourts.gov.in/hcservices/
effect the counsel for the petitioner was directed to file memo by informing the facts.
Accordingly the counsel again called up the petitioner and asked him to take back the bundles till now the petitioner is not responding phone calls. Hence having no other option the counsel for the petitioner was forced to say no instructions by way of this memo and the same may be recorded.
3.It is seen from the aforesaid memo that the petitioner is not interested in pursuing the matter further. 4.Hence, recording the memo dated 07.03.2019 filed by the petitioner, this criminal revision stands dismissed.
