CMP.Nos. 212 to 214 of 2011 in C.M.P.No.9052 of 2005 in S.A.No.SR61515 of 2004 P.T.ASHA, J., These Civil Miscellaneous Petition Nos.212, 213 & 214/2011 are filed for condoning the delay of 545 days in seeking to set aside the abatement caused by the death of the first respondent in the above second appeal(S.A.No.SR61515 of 2001).

2. The legal notice which has been taken by the proposed party has been served on RR 4,5,7 &10 and notice sent to RR6 and 9 has been returned with an endorsement as 'not found' . Considering the fact that the legal heirs have been served and they have not entered appearance. The service is deemed to be completed.

3. Sufficient reasons adduced in affidavit filed in support of the petitions, delay is condoned and petitions are ordered.

4. Registry is directed to post the CMP.No.9052/2005 on 11.02.2019.
