ORDER

Seeking a direction to the respondent police to register the FIR based on the complaint given by the petitioner dated 16.08.2013 on the file of the respondent vide C.S.R.No.583/CSR/V5XPS/14 dated 08.11.2014 and to investigate and file the final report, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3.From a perusal of the materials available on record, it appears that the petitioner has given a complaint. Based on which, petition enquiry was conducted and during the course of the enquiry, the opposite party seems to be given a cheque to the petitioner and the said cheque had bounced.

4.Considering the submissions made by the learned counsel on either side, the respondent police is directed to conduct enquiry in CSR No.583/2014 and take action in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)]..

5. This Criminal Original Petition is disposed of with the above direction.
