These petitions are filed (i) to condone the delay of 113 days seeking to set aside the abatement caused due to the death of the deceased 1st appellant Nataraja Gounder in the above appeal and (ii) to set aside the abatement caused due to the death of the deceased 1st appellant Nataraja Gounder in the above appeal and (iii) to bring on record the appellants 3 to 7 as legal representatives of Nataraja Gounder (deceased 1st appellant herein) as mentioned in the accompanying petition and rank them as 2 to 6 in the above appeal. 2.

Heard both sides.

The matter is pending for nearly 24 years. Considering the averments made in the affidavits filed in support of the petitions, these petitions are ordered as prayed for.

01.04.2021 AT Note: Mr. A.R. Nixon, learned counsel for the petitioners would contend that C.M.A.No.736 of 1995 is connected with the second appeal, challenging the order of remand. Registry is directed to post the CMA.No.736 of 1995 along with the second appeal before the roster Court on 17.04.2021.
