The Petitioner/A2 seek anticipatory bail in Crime No.826 of 2023 registered by the Respondent Police for the offences under Section 8(c) read with 20(b)(ii)(B) of NDPS Act.

2. It is the case of the Respondent that the Respondent conducted search in Omni bus in Tiruppur and they had seized 6 Kgs of Ganja from the Accused A1. It had been stated that the Accused A1 had been detained under Tamil Nadu Act 14 of 1982. The Accused A1 had confessed that this Petitioner is the supplier of Ganja products from Andhra Pradesh.

3. The learned counsel for the Petitioner submitted that the name of the Petitioner does not found place in the F.I.R.

4. The learned Government Advocate (Criminal Side) has filed a counter stating that the Accused A1 had been detained under Tamil Nadu Act 14 of 1982 and this Petitioner is the supplier of Ganja. 1/3

5. The earlier anticipatory bail application had been dismissed on 21.11.2023 in Crl.O.P.No.25281 of 2023. There is no change in circumstances. A counter had been again filed by the Respondent stating that the Petitioner herein is evading arrest and that the investigation could not be completed.

6. Taking that particular fact into consideration, I am not inclined to grant anticipatory bail to the Petitioner herein. Accordingly, this Criminal Original Petition stands dismissed.
