(CR.NO.652/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed by this Hon`ble Court vide order dated 22.12.2021 in Crl.O.P.No. 25168/2021 on the file of the Hon`ble Court. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. R.BASKAR, Advocate for the petitioner and of MR.A.GOKULAKRISHNAN Additional Public Prosecutor on behalf of the Respondent the court made the following order:- The Petitioners have filed in Crl.O.P.No.25168 of 2021 seeking anticipatory bail in Crime No.652 of 2021 on the file of the respondent police.
This Court considering the submission made on behalf of the petitioners and upon hearing the learned government Advocate (Crl.Side) and passed on order dated 22.12.2021 imposing certain conditions. One of the condition was that the petitioners were directed to deposit a sum of Rs.10,000/-(Rupees Ten Thousand only) to the credit of the Crime No.652 of 2021 and this Court permitted the defacto complainant to withdraw the said amount on proper identification and acknowledgement.
2. While, the matter comes to that, the petitioners have filed the present Cr.M.P.No.387 of 2022 seeking modify the above conditions.
3. Heard the learned counsel appearing for the petitioners.
4. For the reason stated in the affidavit in support of this miscellaneous petition, the condition that the petitioners to deposit a sum of Rs.10,000/-(Rupees Ten Thousand only) to the credit of Crime No.652 of 2021 and the permission given to the defacto complainant to withdraw the said amount on proper identification and acknowledgment are hereby withdrawn.
