Criminal Revision Case filed under Section 438 r/w. Section 442 of BNSS Act, to set aside the fair order dated 21/11/2024 MP.No.628 of 2023 in M.C.No.150 of 2022 on the file of the V Additional Family Court as illegal, incompetent and without jurisdiction.

Mrs.S.P.Arthi For Respondent in Crl.R.C.No.39 of 2025 & Petitioner in Crl.R.C.No.255 of Mr.Avinash Wadhwani COMMON ORDER The criminal revision case viz., Crl.R.C.No.39 of 2025 has been filed by the wife and the three children, seeking enhancement of the interim maintenance awarded pending M.C.No.150 of 2022 on the file of V Additional Family Court, Chennai.

The criminal revision case viz., Crl.R.C.No.255 of 2025 has been filed by the husband, challenging the order, stating that the learned judge ought not to have directed the payment of interim maintenance without adjudicating his claim in M.C.No.150 of 2022 pending on the file of V Additional Family Court, Chennai.
3. It is the claim of the first petitioner/wife in Crl.R.C.No.39 of 2025 that the respondent/husband is well to do and he has not paid any maintenance
to the petitioners sofar.
4. It is the claim of the respondent/husband that the first petitioner is well to do; that the respondent had settled several properties in favour of the first petitioner/wife and that the claim for maintenance is only to harass him.
5. Admittedly, the maintenance case is pending adjudication before the learned Judge. It is reported that the trial has commenced and PW1 has been examined in-chief and is now being cross examined.
6. In the light of the above submissions, this Court is of the view that, ends of justice would be met, if both the revisions are disposed of on the following terms:
(i) The respondent/husband shall pay a sum of Rs.5,00,000/- (Rupees Five Lakhs only) on or before 31.01.2026 to the petitioners in Crl.R.C.No.39 of 2025.
(ii) The order impugned shall remain stayed until the disposal of the M.C.No.150 of 2022 on the file of V Additional Family Court, Chennai, on payment of the said amount of Rs.5,00,000/-.
(iii) The learned Judge is directed to dispose of M.C.No.150 of 2022 on the file of V Additional Family Court, Chennai, within a period of eight (8)
weeks from the date of receipt of a copy of this order. (iv) Consequently, connected Miscellaneous Petition is closed.
7. At this stage, the learned counsel for the first petitioner/wife would submit that the first petitioner intends to file a transfer petition for certain reasons. This Court is not concerned with the said reasons and it is for the Court concerned to decide the transfer petition on merits.
8. However, it is needless to say that the direction issued by this Court for early disposal would be subject to any order that may be passed in the transfer petition, if any filed.
