ORDER

The petitioner, who was arrested and remanded to judicial custody on 18.11.2025 for the offences punishable under Sections 194(3) (1) of BNSS and @ 118(1), 80(2) of BNS & Section 4 of Dowry Prohibition Act, in Crime No.528 of 2025, registered on the file of the respondent police, seeks bail.

The allegation against the petitioner herein is that, the petitioner is the husband of the deceased in this case; that their marriage was solemnized on 08.09.2024 at Arakonam with the consent of both families; that after the marriage, the petitioner started harassing the deceased, demanded dowry and additional jewels; that out of mental agony, the deceased had committed suicide by hanging. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is a Doctor by profession and he is in judicial custody since 18.11.2025; that the petitioner and the deceased loved each other and with the consent of both families, their marriage was solemnized on 08.09.2024; that on account of their respective work location and for betterment in the career, both stayed in different places, which created misunderstandings between them, hence they were not able to live together, which caused stress and embarrassment to the deceased, hence she committed suicide; that there is no demand of dowry; and that the petitioner is ready to abide by any condition that may be imposed by this Court, hence prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution

case and submitted that the RDO report reveals that it is the case of dowry death; and that the investigation of this case is pending.

5. Earlier this court has dismissed the bail application of the petitioner in Crl.OP.No.33494 of 2025 vide order dated 09.12.2025 and now it is reported that investigation is concluded and final report is also filed. Hence this Court is inclined to grant bail with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate, Ambattur, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the Judicial Magistrate, Ambattur, daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation. [c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial;

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the K. RAJASEKAR, J.

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section B.N.S.
