Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Section 366 A IPC in Crime No.87 of 2016 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have abducted a girl aged about 15 years, who is the daughter of the defacto complainant.

3. The learned counsel for the petitioner submitted that the petitioner had fallen in love with the minor girl. He further submitted that the petitioner is innocent and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) on instructions submitted that the girl has been secured.

5. Taking note of the fact that the minor girl has been secured and also custodial interrogation of the petitioner is not required in this case, I am inclined to grant interim bail to the petitioner.

6. Accordingly, the petitioner is ordered to be released on interim bail on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the Judicial Magistrate, Paramathi, Namakkal District and on further condition that: [a] Interim anticipatory bail is granted to the petitioner till 18.07.2016.

kal [b] the petitioner shall appear before the respondent police daily at 10.30 a.m. until further Orders.

[c] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[d] the petitioner shall not abscond either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
