M/S.Royal Classic Mills Private Limited v. The Deputy Commissioner Of Gst

in W.P.No.384 of 2023 M.SUNDAR.J., Captioned 'Writ Miscellaneous Petition' ['WMP'] has been filed with a prayer to dispense with production of original of an 'order bearing reference RFD-06 REFUND SANCTION ORDER' [hereinafter 'impugned order' for the sake of brevity, convenience and clarity].

Learned counsel for writ petitioner, adverting to the support affidavit submitted that a digital/soft copy of the impugned order was served on the petitioner through online mode and that has necessitated the captioned WMP. Learned counsel drew the attention of this Court to Paragraph 14 of the support affidavit, which reads as follows: '14.Since that the impugned order in RFD-06 Refund/Sanction order passed by the respondent was received on 28.9.2022 through GST portal, the same is only available with the petitioner and so based on the online copy, this writ petition filed.'

3. In the light of the narrative thus far, dispense with prayer is acceded to. Captioned WMP ordered as prayed for. There shall be no order as to costs.
