Respondents PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 3 to take appropriate legal action based on petitioner's representation dated 04.10.2018 to remove the encroachment of the Government poramboke vacant land in Survey Nos.396, 397 and 398 to an extent of 2375 Square feet situated at Malai Road, Nungampalayam Main Road, Nungampalayam Village, Tambaram Taluk, Kancheepuram District by the 4th respondent within a time frame. ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard Mr.S.Sugendran, learned counsel for the petitioner; Mr.S.Kamalesh Kannan, learned Government Advocate for respondents 1 to 3 and Mrs.S.Deepika, learned counsel for the fourth respondent.

2. The petitioner is seeking directions to respondents 1 to 3 to take appropriate legal action for removal of encroachment made by the fourth respondent on Government poramboke vacant land in Survey Nos.396, 397 and 398 to an extent of 2375 Square feet situated at Malai Road, Nungampalayam Main Road, Nungampalayam Village, Tambaram Taluk, Kancheepuram District. The petitioner has also preferred a representation to respondents 1 to 3 in relation to the removal of the said encroachment.

Mr.S.Kamalesh Kannan, learned Government Advocate has filed a status report of the third respondent, i.e., the Tahsildar, Tambaram Taluk, Kancheepuram District, wherein it is stated that field inspection was conducted by the Medavakkam Firka Revenue Inspector, Medavakkam Firka Surveyor along with other officials at Perumbakkam Village, Tambaram Taluk, Kancheepuram District and it was found that the fourth respondent has encroached an extent of approximately 940 sq.ft. by way of a car shed at Survey No.398/5, Perumbakkam Village, which his classified as "Tharisu" Government Poramboke land. It is further stated that in relation to the said encroachment made by the fourth respondent, they have issued a notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, which is dated 9.7.2019, and the eviction process will be completed in accordance with law, as expeditiously as possible.

4. Thus, it is seen that the authorities are taking action in relation to the said encroachment. Therefore, at this stage, no further directions are necessary.
