ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.10.2025 for the offences punishable under Sections 5(l), 5(n), 5(m), 9(m), 6(1) of POCSO Act, in Crime No.58 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, he is the neighbour of the victim girl aged about 11 years and taking advantage of her loneliness and this petition committed aggravated penetrative sexual assault. Hence this case. 1/4

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and the petitioner is in judicial custody since 30.10.2025; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that totally 3 accused in this case and all were arrested and petitioner is also involved in this case, committed aggravated penetrative sexual assault to the victim girl and opposed for grant of bail to the petitioner.

5. Earlier this court has dismissed the bail petition of the petitioner on 19.12.2025 on the ground of the age of the victim girl and that the petitioner has also committed aggravated penetrative sexual assault and investigation is still pending in this case.

6. Since there is no change in circumstances established before this Court to warrant reconsideration of the earlier order, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 09.01.2026 gv 2/4
