ORDER

It is the case of the petitioner that after completion of education, he registered with the employment exchange on 8.3.1990 for the post of drawing teacher. The petitioner was initially called for certificate verification in December, 1996, but he was not selected and, thereafter he was called for interview for the post of Special Teacher during November, 2004 in which also the candidature of the petitioner was not considered. Thereafter, the petitioner was called for interview

for the post of drawing teacher on 14.5.2010 in which the petitioner was not selected. Similarly he was not selected for the post of Special Teacher during April, 2012. In this regard, the petitioner sent a representation to the 2nd respondent to consider his case and since no orders was passed, the petitioner filed W.P. No.26125/2012, which is pending.

It is the further case of the petitioner that based on enquiries made under the Right to Information Act, the petitioner came to know that there are three temporary posts and based on the said information, the petitioner sent a representation to the 3rd respondent praying to consider his case for appointment in one of the posts. However, he was informed that the said posts will be filled up only after announcement from the Government. Since the action of the respondents in not selecting his case four times and also not considering his candidature for the temporary post, the present petition has been filed.

When the matter is taken up for hearing, learned Special Government Pleader appearing for the 2nd respondent submitted that the writ petition has been filed in the year 2013 and that no posts are available as of now. However, this Court may permit the petitioner to participate in the selection process for future vacant posts of drawing teacher, if and when available.

4. Learned counsel appearing for the petitioner, though reiterated the contentions raised in the grounds, however, fairly conceded that the petition being of the year 2013, the said temporary post may not be available. Therefore, this Court may permit the petitioner to partake in the selection process for future arising vacancies.

5. Having heard the learned counsel appearing on either side and in view of the limited relief sought for, this writ petition is dismissed and liberty is granted to the petitioner to participate in the selection process for future arising vacancies and if found eligible, the case of appointment of the petitioner may be considered in accordance with law.
