This application had been filed seeking to set aside the order dated 06.12.2023 by which order, the original petition was dismissed for non prosecution.

2. The petition has been filed seeking grant of Letters of Administration with Will annexed and it would only appropriate that opportunity is granted to prove the Will in manner known to law. The Original Petition was dismissed at the stage of issuing notice to the respondents.

3. The learned counsel for the petitioner raised reasonable reasons for non appearance on 06.12.2023. Taking into consideration all the factors, this Application stands allowed.
